Conditions of Sale

1. TERMS OF PARTICIPATION:

Before starting the excursion, you must certify:

Minimum age: Participants must be at least 18 years old to drive a quad. Passengers must be at least 7 years old or have a minimum height of 1.30 m.
Driver’s license: Drivers must possess a valid driver’s license for motor vehicles, which must be presented on-site.
Clothing: Closed-toe footwear and clothing suitable for weather conditions are recommended.
Physical conditions: Participants must be in good health and have no contraindications for engaging in physical and sports activities.
Pregnant women are not allowed to participate in our activities. Additionally, participants must not be under the influence of alcohol, drugs, or any other substance that may impair their ability to participate safely.

2. SAFETY MEASURES:

By participating in the excursion, you agree to:
– Follow the instructor’s instructions and adhere to safety precautions and rules,
– Respect traffic regulations and the environment (other users, animals, residents, etc.),
– Acknowledge that quad biking involves risks and accept the resulting conditions: the instructor is not liable for accidents resulting from individual irresponsible behavior. Any failure to comply with safety instructions may result in the participant’s exclusion without refund.

3. Reservation and Payment:

– Quad excursion bookings can be made online, by phone, or in person.
– Full payment is required at the time of booking unless otherwise stated.
– Accepted payment terms are specified at the time of booking.

All mentioned rates and prices are subject to product or service availability. Prices are subject to change until full payment is received and corresponding vouchers are issued.

Experiences offered on this site are subject to availability and may be withdrawn without prior notice. Booking will be confirmed only after receiving full payment.

4. Cancellation and Modification by the Client:

Any cancellation or modification of a booking must be notified to the service provider in writing.

Cancellations/changes to your excursion up to 48 hours before the departure date: 100% refund.
Cancellations of your adventure up to 24 hours before the departure date: 50% refund.
Cancellations after 24 hours before departure: no refund.
€5 fee for any cancellation.

MALLOR’QUAD reserves the right to cancel excursions, modify itineraries, and change opening days.

If a tour is canceled due to weather conditions, mechanical breakdowns, unsafe conditions, or route closure, we will offer to reschedule your tour for a later date at no additional cost.
If this alternative is not suitable for you, a refund will be provided.

A minimum of 2 quads is required for this excursion.
If the minimum number of vehicles is not reached, we may contact you 12 hours before your visit to reschedule your excursion.

Please note that no refunds will be granted for canceled excursions due to misrepresentation of physical abilities and/or nondisclosure of existing health conditions affecting your ability to complete the excursion.

If a customer fails to provide or refuses to answer specific questions in the MALLOR’QUAD questionnaire, we reserve the right to reject the service without the possibility of a refund. These questions include essential information such as driver’s license details and participant contact information.

A driver’s license must be presented on-site. Failure to present it will prohibit the participant from driving the quad, and no refund will be issued.

MALLOR’QUAD will not grant any refunds for issues related to inappropriate customer behavior.

No refunds will be made for unused activities.

No refunds will be made in case of inability to complete activities once commenced.

Additionally, if the quad needs to be picked up more than 5 km from the base for unjustified reasons, a fixed fee of €50 will be applied.

5. Liability:

– The service provider guarantees the safety of participants during the excursion but is not liable for accidents resulting from irresponsible behavior or failure to comply with the guide’s instructions.
– The customer is obliged to respect the rules of conduct and safety instructions provided by the guide.

6. Insurance:

– The guide is covered by organizational liability insurance, with the obligation to provide necessary means under normal traffic conditions.

Under these same conditions, our vehicles are insured for bodily injury caused to third parties.
However, any violation of rules or instructions given by the guide will void these guarantees.

In this case, the driver will be fully responsible. It is recommended to obtain individual liability insurance if you do not already have one, to protect yourself in case of an accident.

7. Equipment and Protective Gear:

– The service provider supplies the necessary equipment for the quad excursion, including helmets.
– The customer is responsible for the proper use of supplied equipment and may be held accountable for damages caused to it in case of negligence or abuse.

Any material damage resulting from failure to comply with safety instructions will be subject to repair costs.
The driver will be responsible for covering repair expenses for damages caused to equipment, in accordance with prevailing rates, plus labor costs, with a maximum deductible of €1,500.

8. Confidentiality:

Personal information provided by the customer as part of the reservation will be processed in accordance with the provider’s privacy policy.

By booking a quad excursion with the service provider, the customer acknowledges having read, understood, and accepted these general terms of sale.
